Petitioner was tried by general court-martial for manslaughter in violation of Article of War 93, 10 USC § 1565. The charge and specification were that the petitioner at Verdun, France, feloniously and unlawfully killed Umberto Patti, by running into him with a motor vehicle. After a trial 'on the merits, the court found petitioner guilty as charged and sentenced him to be dishonorably discharged from the service, to forfeit all pay and allowances, and to be confined for the period *337of 2 years.
