In an action to recover damages for legal malpractice, the defendants E. Michael Kosan and Fredman & Kosan, LLE appeal from an order of the Supreme Court, Westchester County (Barone, J), entered February 28, 2003, which denied their mo*386tion for summary judgment dismissing the complaint insofar as asserted against them.

Ordered that the order is reversed, on the law, with costs, the motion is granted, and the complaint is dismissed insofar as asserted against the appellants.
