BARNES, Justice:

This appeal involves an action for damages for personal injuries sustained by a lineman in dismantling a telephone line on an easement owned by Mobil Pipe Line Company, hereinafter referred to as “Mod-bil” or “defendant”. Mobil’s said easement traversed a distance of some 90 miles between Oklahoma City and this State’s Drumright-Yale area. On it, Mobil installed its private telephone system many years ago and thereafter used the system in connection with its pipe line operations.
