*782Proceeding pursuant to CPLR article 78 to prohibit the respondents from enforcing an order of the County Court, Orange County (DeRosa, J.), dated January 26, 2006, which directed the petitioner to furnish buccal swab samples upon notice from the District Attorney in connection with the investigation of the death of a named individual.
Adjudged that the petition is granted, on the law, without costs or disbursements, and the respondents are prohibited from enforcing the order dated January 26, 2006.
