WIEAND, Judge:

This is an appeal by the Commonwealth from an order suppressing marijuana found in and removed from a vehicle being driven by Alfred Evans. The suppression order was entered by the Municipal Court of Philadelphia, and the Court *355of Common Pleas denied certiorari. It is from this order that the present appeal was taken.1
