The National Environmental Protection Act (NEPA), 42 U.S.C. § 4321 et seq. (2012), is designed to ensure that federal officials seriously study the environmental effects and implications of any major federal action before proceeding. As this aged litigation makes clear, NEPA’s requirements cannot be sidestepped. In the end, however, NEPA does not dictate the outcome of an agency decision.
