THIS MATTER comes before the Court on Defendant OAO Lukoil’s (“Lukoil”) Motion to Dismiss (“Motion”) Plaintiff Archangel Diamond Corporation Liquidating Trust’s (“Trust”), as successor-in-interest to Archangel Diamond Corporation (“Archangel”), Complaint pursuant to Fed.R.Civ.P. 12(b)(2), 12(b)(6), and under abstention theories.
