Defendant appeals his conviction for failure to appear in the first degree, ORS 162.205, assigning error to the trial court’s denial of his motion for a judgment of acquittal on that charge. In particular, he contends that the state failed to prove that the release agreement on which the state based the charge released him “from custody,” as required by the statute. ORS 162.205(l)(a).
