It was alleged in the complaint in this cause that the appellant, Nellie Sourbier, as guardian for Edward G. Sourbier, was appointed as such guardian on the 17th day of December, 1929, in a proceeding in the Marion Probate Court wherein the said Edward G. Sourbier, her husband, was declared to be mentally incompetent and that she thereafter qualified and was acting as such guardian. The complaint also charged that The Fletcher American National Bank of Indianapolis, Indiana, was a trustee of certain property placed in trust with it by the said Edward G.
