Appeal from an order of the Supreme Court (Lynch, J.), entered February 24, 2009 in Albany County, which, among other things, denied plaintiffs motion for partial summary judgment.

Defendants Carlton J. Burth and James G. Stasaitis, Jr. (hereinafter collectively referred to as defendants) own real property in the City of Utica, Oneida County, where they operate their automobile repair business, defendant C.J.
