MEMORANDUM OPINION AND ORDER

This cause is before the Court on Defendants’ Motion for Summary Judgment, (Doc. # 16), filed on January 6, 2011. On June 6, 2007, an automobile accident occurred on Highway 231 in Alabama that resulted in the death of Coleman Zatarain (“Zatarain”).
