The opinion of this court by Judge Randolph on a.former appeal of this case, reversing the judgment, and the reasons therefor, is reported in 10 S.W.(2d) 760. It is only necessary to add to the statement of the pleadings of defendants in error contained in the former opinion that at the last trial, by amended petition, the defendants in error alleged that the deceased, W.
