This matter is before the Court on Plaintiff Equal Employment Opportunity Commission’s (“the EEOC”) Motion for Judgment on the Pleadings [Doc. No. 22] and PlaintiffIntervenor Grant Habighorst’s (“Habighorst”) Motion for Judgment on the Pleadings [Doc. No. 26] (collectively, “Motions for Judgment on the Pleadings” or “Motions”).
