MEMORANDUM OPINION & ORDER

The Defendants in this case have filed a motion for summary judgment. (Doc. No. 9.) Plaintiff has filed an opposition to the motion (Doc. No. 14) and Defendants subsequently have replied (Doc. No. 15). While the motion for summary judgment was under advisement, the Court sua sponte raised the issue of whether this action is an impermissible collateral attack on a judgment and/or is barred by the doctrine of res judicata.
