Action of contract to recover $597.65 paid to the defendant through his alleged coercion and compulsion under the following circumstances:

On October 16, 1958, the plaintiff was the owner of the premises numbered 186-194 Kelton Street and 162-164 Allston Street, in *204the Brighton section of Boston; that the defendant held a purchase-price mortgage thereon in the sum of $93,000; that prior to July 1, 1958, the plaintiff made certain alterations to the heating system of its properties which the defendant contended were voluntary waste, causing the defendant to file a Bill in Equity in the Suffolk…
