CHRISTIAN, Judge.

— The offense is swindling; the punishment, confinement in the penitentiary for ten years.

Appellant was president of Wimer-Richardson & Company, a corporation, with its place of business in San Antonio, Texas. Under the authority of its charter the company from time to time issued its own interest-bearing investment certificates for sale to the public.
