On December 23d 1933, the defendant insurance company by its agent, Arthur J. Sullivan, issued its policy insuring one Harry Kuller for the term of three years, from January 21st, 1934, against loss or damage by fire, to an amount not exceeding $8,000, to the property located at 11 Randolph street, in the city of Passaic, New Jersey. On December 6th, 1936, and while said policy was still in full force and effect, the property in question was completely destroyed by fire.
