I. INTRODUCTION
The plaintiff, Martek Biosciences Corporation (“Martek”), filed the above-captioned action- against Nutrinova Inc. and Nutrinova Nutrition Specialties & Food Ingredients GMBH 1 (collectively, “Lonza” or the “defendants”) on September 23, 2003, alleging infringement of United States Patent Nos. 6,607,900 (the “'900 patent”) and 6,451,567 (the “'567 patent”) by Lonza’s activities with regard to its docosahexaenoic acid (“DHA”) product, produced by microalgae and marketed under the brand names DHActiveTM, Nutrinova® DHA, and Lonza DHA.
