HOUSTON, Justice.
Mary E. Nelson sued AmSouth Bank, N.A., seeking to recover $35,000 that she alleged AmSouth had negligently paid to Dorothy L. Davis from an account that Nelson had jointly owned with her deceased father, James W. Davis. Nelson maintained that she and her father had owned the account jointly with a right of survivorship, and that the right of survivor-ship entitled her to all of the money in the account upon her father’s death.
