CASE SUMMARY

This is an appeal from a conviction for third degree burglary committed in violation of SDCL 22-32-9 and SDCL 22-3-3. 1 On his appeal, defendant contends: (1) That a directed verdict should have been granted because the evidence was insufficient to support the verdict; (2) certain cash register keys should not have been admitted in evidence; and (3) the trial court should have granted a change of venue from Roberts County because of prejudice within the county against native American Indians.
