— The petition alleges, in substance, that on tbe fifteenth day of June, 1891, the plaintiff entered into an oral contract of insurance with one of the defendant’s local agents, who had authority to make contracts of insurance and to issue policies, by which the defendant, through its said agent, agreed to insure against fire the plaintiff’s “stock of drugs, candies, nuts; etc., and drug house.furniture,” for the space of one year fcr the sum of $800; that the plaintiff paid the premium, and that the agent agreed to deliver to plaintiff one of the defendant’s policies setting forth the terms…
