MEMORANDUM OPINION

JOYCE HENS GREEN, District Judge.

This matter is before the Court on cross motions for summary judgment. 2 For the reasons elaborated below, the Court grants defendant’s motion and denies plaintiffs motion, and this case stands dismissed.
