MEMORANDUM
MERHIGE, District Judge.
Petitioner, William Bart Hamilton, seeks a writ of habeas corpus pursuant to 28 U.S.C. § 2254, challenging his state court convictions upon three felony in dictments for the distribution of marijuana by the Hustings Court for the City of Richmond (now the Circuit Court for the City of Richmond, Division I) on the ground that the delay between the dates of the offenses charged and the date of his arrest substantially prejudiced his right to a fair trial and due process of law under the Fifth and Fourteenth Amendments to the Constitution.
