The plaintiffs, who are real estate brokers, 'áued the 'defendants; who are also real estate brokers, on an filleged agreement to divide commissions. The trial judge, sitting with a jury, granted the defendants’ motion for dismissal at the close of the plaintiffs’ case. An appeal was taken to the Appellate Division from the ensuing judgment and we certified it on our own motion.
