In an action upon a life insurance policy the plaintiff had a directed verdict. The defendant has appealed from an order denying its motion for judgment notwithstanding the verdict or for a new trial.

April 26, 1926, Jennie R. Peterson applied to the defendant for insurance on her life, naming her husband, Thomas R. Peterson, the plaintiff, as beneficiary. She paid the premiums until January 26, 1927, when the policy lapsed for nonpayment. March 7, 1927, she applied for reinstatement of the policy and represented in writing to the defendant that to the best of her knowledge and belief she was…
