This is an action of assumpsit on two life insurance policies containing provisions for waiver of premiums and payment of monthly benefits in case of disability. After a jury trial in the superior court the trial justice directed a verdict for the plaintiff and refused to direct a verdict for the defendant. Defendant excepted to the denial of its motion for a directed verdict and also to the granting of the plaintiff’s motion.
