This is an appeal from a judgment dismissing appellant’s action after a general demurrer to the complaint had been sustained. The material facts alleged in the complaint, in substance, are: That prior to the 28th day of June, 1905, *207tbe respondent, Adeline Stontt, as tbe owner of certain real estate in Salt Lake City, entered into a contract in writing-with one Adolpb Fleishman whereby she agreed to sell to him said real estate for a consideration named.
