This action was brought by the plaintiff against the town of Townsend to recover an alleged invalid tax, paid to the town treasurer of the town of Townsend under protest. The tax claimed to be illegal was a county tax levied by the county board of Oconto county at its annual meeting held in 1930. The assessed valuation of the county for the year 1929 was $27,272,295.
