BACKGROUND

I. Procedural History

This is an action for patent infringement brought by Plaintiff Laboratoires Perouse, S.A.S. (“Perouse”) against Defendant Plaintiff W.L. Gore & Associates, Inc. (“Gore”). Perouse alleges that Gore has infringed U.S. Patent No. 6,019,787 (“the '787 patent”) by making, using, selling, and/or offering for sale in the United States products including Gore’s TAG® thoracic endoprosthesis devices and EX-CLUDER® bifurcated endoprosthesis devices.
