This action was brought in the circuit court for the county of Cass, and a trial was had before the court and jury, and at the close of the testimony the court directed a verdict in favor of the defendant.

The claim stated in the declaration substantially is that the plaintiff who was a strong and active man of 29 years of age, entered into the service of the defendant on September 10, 1889, as a laborer, at $1 per day, working in and about repairing tracks of defendant, on *284one of the sections, under the direction of the section boss, and performing such duties as are usually performed by…
