[¶ 1] Mark Johnston appeals from a judgment of the Superior Court (York County, Fritzsche, J.) granting the motion of Maine Energy Recovery Company, Limited Partnership (Maine Energy Recovery) to dismiss Johnston’s second amended complaint with prejudice. Johnston’s complaint alleged a statutory claim for a private nuisance based on odor. The court held that the complaint failed to state a claim upon which relief can be granted pursuant to M.R. Civ.
