— In the year 1923, plaintiff-appellant instituted condemnation proceedings in the district court, to condemn certain lands along the Des Moines River for overflow purposes in the building of a dam. A sheriff’s jury was impaneled, and on the 5th day of July, that body made its return, fixing the damages in the sum of $9,995. As required by law, appellant paid that sum to the appellee George S. Bassett, who was then sheriff of Webster County.
