MEMORANDUM AND ORDER

ALLEN SHARP, Chief Judge.

This cause is before the court on six motions to dismiss of the various defendants. 1 All defendants challenge the merits of the claim presented in plaintiffs complaint and request that this action be dismissed pursuant to F.R.Civ.P. 12(b)(1) for lack of jurisdiction over the subject matter and/or F.R.Civ.P. 12(b)(6) for failing to state a claim upon which relief can be granted.
