Appeal by the defendant from a judgment of the Supreme Court, Kings County (Friedman, J.), rendered December 5, 1997, convicting him of manslaughter in the second degree, upon a jury verdict, and imposing sentence.

Ordered that the judgment is reversed, on the law, and the indictment is dismissed, without prejudice to the People to represent any appropriate charges to another Grand Jury (see, People v Bradley, 88 NY2d 901, 904; People v Beslanovics, 57 NY2d 726); and it is further,
