On January 13,1971, Thomas Evans filed a charge of racial discrimination with the Equal Employment Opportunity Commission (EEOC) naming U.S. Pipe & Foundry and the Molders Union as respondents. Evans alleged that the company failed “to permanently promote me”; that he was discriminated against with respect to unspecified terms and conditions of employment; that he was harassed on the job; and that the union failed to adequately represent him.
