THIS MATTER comes before the Court on the Defendant J & M Discount Towing, LLC’s Motion to Dismiss Plaintiffs Complaint Against J & M With Prejudice and Memorandum in Support, filed June 28, 2006 (Doc. 12)(“Motion to Dismiss”).
