This is the third time this case has come before us. On November 4, 1980, a jury convicted the defendant of murder in the first degree. The defendant appealed from his conviction to this court. On direct review, we exercised our power under G. L. c. 278, § 33E, and reduced the verdict to murder in the second degree. Commonwealth v. Lanoue, 392 Mass. 583 ((Lanoue I).
