Rohde against James Seavey to compel him as auditor of Jefferson county to draw a warrant in favor of plaintiff for salary as justice of the peace in and for Port Townsend. Judgment for defendant. The cause is certified to the supreme court by the judge of the superior court of Jefferson county for its decision of certain questions of law.

This cause comes here on appeal from a pro forma judgment rendered in the court below, and a certifi*92cate of the judge thereof that the decision of certain questions of law is material and necessary to a proper disposition of the case.
