The defendant was convicted of the crime of embezzlement and has appealed from the judgment of conviction and from an order denying his motion for a new trial.

The criminal information on which the prosecution is based charges that one Juengling, the county treasurer of McIntosh county, on January 1, 1939, comimtted the crime of embezzlement “by converting to his own use certain moneys and securities of the sum of $1,084, which' said money and securities were then and there the property of the said county of McIntosh and state of North Dakota and other legal subdivisions thereof, and not the…
