MEMORANDUM OPINION AND ORDER

WATKINS, District Judge.

Petitioner, presently incarcerated in the Maryland Penitentiary, seeks the issuance of a writ of habeas corpus. Petitioner was convicted on October 26, 1962 in the Circuit Court for Cecil Coun ty before Judge Edward D. E. Rollins sitting with a jury, of forgery, uttering a forged instrument and false pretenses. He had entered a plea of not guilty and was represented by court appointed counsel.
