APPEAL from an order of the Monroe Special Term ordering this suit to be revived and continned, on a supplemental complaint in the name of Henry B. Hewett, administrator, with the will annexed of the plaintiff, deceased.

This was a suit in equity, commenced before the Code, by filing a bill and issuing a subpoena to answer, on the 38th day of June, 1848. The cause of action, and grounds of equitable jurisdiction, set up in the complaint, are founded upon certain *500loose and obscure contracts between the parties, then all residents , of Rochester, growing out of an attempted speculation in pine lands, in the State of Maine, in the year 1835..
