This action of tort was brought to recover compensation for personal injuries sustained by the original plaintiff, Jennie Fuller, in the circumstances recited below. At the close of the evidence the defendant made certain requests for rulings, to the effect that upon the evidence, upon the law, and upon the law and the evidence the plaintiff was not entitled to recover, which were denied by the judge sitting without a jury, subject to the defendant’s exceptions.
