The above actions were instituted in the Passaic County Circuit Court. They arose out of the same transaction and were tried together. The suit instituted by Israel H. Maagget was to recover commissions for selling to the Vogue Silk Company, the plaintiff in the other action, silk belonging to the A. Brawer Silk Company. Maagget claimed that ihe defendant had agreed to pay him a commission of three per cent, on the gross amount of the sale, and had failed to do so, and also had failed to pay him a balance of $204 due on a sale of silk…
