The petitioner, J. E. MacLean, presents an application to this court for a writ of habeas corpus to secure his release from the penitentiary in which he is incarcerated pursuant to a judg*679ment of the district court of Shawnee county which was affirmed by this court on July 6, 1935. (State v. MacLean, 142 Kan. 215, 46 P. 2d 879.)
