This is an original proceeding in habeas corpus. The petitioner, James Darwin Kneisley, seeks release from the state penitentiary where he is serving a sentence of from one to five years for grand larceny. Upon proper showing by petitioner that he was without funds, an order was made permitting the filing of the petition without deposit of costs, and for appointment of counsel to represent him.
