This is a proceeding by Charles E. Schumer pursuant to CPLR article 78 for a judgment (1) directing Kings County District Attorney Elizabeth Holtzman to rescind the appointment of David G. Trager to the position of Special Assistant District Attorney and (2) prohibiting Mr. Trager from undertaking any duties pursuant to the appointment and Memorandum of Understanding dated May 4, 1983.
