The appellee, Mrs. Aubrey J. Thibo-deaux, for herself and four minor children brought this action against the appellant in the State Court following the award of the Texas Industrial Accident Board denying the recovery of death benefits under the Texas Workmen’s Compensation Statute for the death of her husband. It was alleged the decedent sustained accidental injuries resulting in death, while engaged in the scope of his employment, as an employee of the Texas Fisherman’s Cooperative Association, Inc.
