FOLLMER, District Judge.
This is a motion to dismiss the Information because the Information does not. state facts sufficient to constitute an offense against the United States of America.
The Information charges that:
“On or about the 5th day of December 1953, in the City of York, Middle District of Pennsylvania, and within the jurisdiction of this Court, George Donald Shirey, in violation of the Act of Congress, June 25, 1948, c. 645, Sec. 1, 62 Stat. 694, 18 U.S.C.
