KILLITS, District Judge.
This is an action for damages, only, for breach of a contract of marriage. The plaintiff is a resident of this district. The defendant resides in the district of Nebraska. The action is brought in this court. On the praecipe of the plaintiff a summons from this court was issued to the marshal of the district of Nebraska for service upon the defendant in the latter’s home district, and the return shows service had at Ravenna, Neb. The petition alleges the diverse citizenship of the parties.
