—In an action, inter alia, pursuant to Labor Law § 740, the plaintiff appeals, as limited by his brief, from so much of an order of the Supreme Court, Nassau County (Bucaria, J.), dated January 25, 1999, as granted the defendants’ motion pursuant to CPLR 3211 (a) (7) and (8) to dismiss the complaint.

Ordered that the order is modified, on the law, by deleting the provisions thereof granting those branches of the motion which were to dismiss the fifth cause of action to recover damages pursuant to Labor Law § 740 and the sixth cause of action to recover damages for tortious interference with…
